These Terms & Conditions ("Terms") govern your access to and use of TasteTrek (the "App," "Service," or "TasteTrek"), a homemade food marketplace owned and operated by Caretrace LLC ("Caretrace," "we," "our," or "us"), including our mobile applications, website, and related services.
By creating an account, downloading, accessing, or using TasteTrek, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Service.

1. Acceptance of Terms
These Terms form a binding agreement between you and Caretrace LLC. They apply to every user of the Service, whether you browse listings, purchase meals as a buyer, or list and sell food as a cook. By continuing to use the Service after any update to these Terms, you accept the revised Terms.
2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and transact on TasteTrek. By using the Service, you represent that you meet this requirement and that the information you provide is accurate and complete.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You agree to notify us promptly at support@tastetrek.net of any unauthorized use of your account or any other security breach.
- You may sign in using a third-party authentication provider (such as Google Sign-In). Your use of that provider is subject to its own terms.
- We may refuse, suspend, or terminate accounts at our discretion, including where required to comply with law or to protect the Service and its users.
3. The Service & Our Role
TasteTrek is a marketplace that connects independent home cooks with people who want to discover and enjoy homemade meals in their local community. We provide the platform that makes listings discoverable, facilitates communication, and supports order coordination and in-person pickup.
Important: TasteTrek is a venue and intermediary only. We are not the producer, seller, manufacturer, or distributor of any food listed on the Service. We do not prepare, handle, inspect, license, certify, or take ownership of any food item. All food is prepared and sold by independent cooks who are solely responsible for their products.
Any contract for the sale of food is formed directly between the buyer and the cook. TasteTrek is not a party to that transaction and does not guarantee the quality, safety, legality, or accuracy of any listing.
4. Cottage Food & Regulatory Compliance
Cooks who sell homemade food through TasteTrek are independent producers and are solely responsible for complying with all applicable federal, state, and local cottage food laws, food safety regulations, and licensing requirements in their jurisdiction.
For cooks selling in Colorado, the Colorado Cottage Foods Act (as expanded in 2026) sets the rules that govern homemade food sales. By listing food on TasteTrek, Colorado-based cooks represent and warrant that they meet these requirements, including:
- Food safety training. Before selling, you must complete an approved food safety course (such as the Food Safety Training for Colorado Cottage Food Producers offered through Colorado State University Extension). Certificates are valid for three years. If you sell foods that require time and temperature control (including refrigerated foods, meat, and meat products), your course must cover time- and temperature-control handling.
- Proof of completion. You must acquire and maintain proof of course completion and make it available upon request.
- Direct-to-consumer sales. Cottage foods must be sold directly to an informed end consumer — for example, from your home, at farmers markets and events, or via online orders with in-person pickup. Shipping of cottage foods is not permitted.
- Transport limits for temperature-controlled foods. Foods requiring time and temperature control may not be transported more than once, and may not be in transport for longer than two hours.
- Revenue cap. Annual sales are capped at $10,000 per individual food product.
- Labeling and informed consent. Buyers must be informed that the food is homemade and produced in a kitchen that is not licensed, inspected, or subject to regulation by the state.
TasteTrek does not inspect, license, or certify any cook, kitchen, or food item, and does not verify compliance with cottage food laws. Responsibility for safe food handling, accurate ingredient and allergen disclosure, and legal compliance rests entirely with the cook. Buyers acknowledge that homemade foods sold through TasteTrek are not prepared in a licensed or inspected commercial kitchen.
Cooks outside Colorado are responsible for the cottage food laws of their own state and locality, which may differ and may impose different limits on permitted foods, revenue, labeling, and sales channels. Laws change over time; this summary is provided for convenience only and is not legal advice. You are responsible for confirming the current requirements that apply to you.
5. Cook Obligations
If you list or sell food on TasteTrek, you agree that you will:
- Hold and maintain all training, permits, registrations, and certifications required by law before selling.
- Prepare food in compliance with applicable cottage food and food safety laws, and follow safe food handling, storage, and transport practices.
- Accurately describe each listing, including ingredients, known allergens, dietary tags, pricing, portion availability, and pickup details.
- Provide any legally required labeling and disclosures, including notice that the food is homemade and not prepared in a licensed or inspected kitchen.
- Honor confirmed orders and communicate promptly and honestly with buyers.
- Collect and remit any applicable taxes and comply with all tax obligations arising from your sales.
- Not list or sell any food that is unsafe, prohibited by law, or outside the scope of your permitted cottage food authorization.
6. Buyer Obligations
If you purchase food on TasteTrek, you acknowledge and agree that:
- Food is prepared by independent home cooks in home kitchens that are not licensed or inspected by a regulatory authority.
- You are responsible for reviewing ingredient and allergen information and for asking the cook any questions before purchasing, particularly if you have allergies, intolerances, or dietary restrictions.
- You will coordinate pickup honestly and arrive at agreed times, and treat cooks respectfully.
- You assume the ordinary risks associated with consuming homemade food prepared outside a commercial facility.
7. Food Safety & Allergens
Food sold through TasteTrek may be prepared in kitchens that also handle common allergens such as milk, eggs, peanuts, tree nuts, wheat, soy, fish, shellfish, and sesame. TasteTrek does not verify allergen information and cannot guarantee that any food is free from any allergen or contaminant. Cooks are responsible for accurate allergen disclosure, and buyers are responsible for evaluating whether a food is appropriate for them. If you have a severe allergy, exercise caution and consult the cook directly.
8. Orders, Pickup & Payments
TasteTrek facilitates discovery and coordination of orders for in-person pickup. TasteTrek does not currently process card payments through the App. Any payment arrangements between buyers and cooks are made directly between those parties, and any disputes regarding payment, refunds, quality, or fulfillment are between the buyer and the cook.
If we introduce in-app payment functionality in the future, these Terms and our Privacy Policy will be updated to describe how those transactions and related data are handled, and additional payment terms may apply.
9. User Content & License
"User Content" means any content you submit to the Service, including listings, photos, descriptions, ratings, reviews, and messages. You retain ownership of your User Content. By submitting it, you grant Caretrace a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content for the purpose of operating, promoting, and improving the Service.
You represent that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party or violate any law. You are solely responsible for your User Content and the consequences of posting it.
10. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms or applicable law.
- List, sell, or facilitate the sale of unsafe, mislabeled, or legally prohibited food or other items.
- Misrepresent ingredients, allergens, certifications, or your identity.
- Post false, misleading, defamatory, harassing, or fraudulent content, including fake reviews.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
- Scrape, copy, or harvest data from the Service except as expressly permitted.
- Use the Service to transmit malware or engage in any activity that harms other users.
11. Intellectual Property
The Service, including its software, design, text, graphics, logos, and the "TasteTrek" name and brand, is owned by Caretrace LLC and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, no license or right is granted to you in the Service or any of its content. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.
12. Third-Party Services
The Service integrates with third-party services such as Google Sign-In, Google Firebase, Cloudflare, and mapping providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services. See our Privacy Policy for details on how these services process information.
13. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TasteTrek does not warrant that the Service will be uninterrupted, secure, or error-free, or that any food listed on the Service is safe, accurately described, legally compliant, or fit for consumption. TasteTrek makes no warranty regarding any cook, buyer, listing, or transaction.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARETRACE LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY ILLNESS, INJURY, OR HARM ARISING FROM FOOD PREPARED OR SOLD BY A COOK, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify, defend, and hold harmless Caretrace LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your food products or transactions, or your violation of these Terms or any applicable law.
16. Suspension & Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us or other users, or for any other reason at our discretion. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.
17. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Subject to applicable law, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits any right you may have to bring a claim in small-claims court or before a relevant consumer-protection authority.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App, by email, or by other appropriate means before the changes take effect. The "Last Updated" date at the top of this page indicates when the latest version was published. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
